How to Calculate Tenancy Agreement Stamp Duty

Stamp duty for tenancy agreements in Malaysia is calculated based on the annual rental amount.

The Formula

Stamp Duty = RM1 for every RM250 of annual rent exceeding RM2,400

Step 1: Calculate Annual Rent

Annual Rent = Monthly Rent × 12

Example:

Monthly rent: RM2,000
Annual rent: RM2,000 × 12 = RM24,000

Step 2: Deduct RM2,400 Threshold

RM24,000 – RM2,400 = RM21,600

Step 3: Divide by RM250

RM21,600 ÷ 250 = 86.4
Rounded up = 87 units

Step 4: Multiply by RM1

Stamp Duty Payable = RM87

Important Notes

  • The amount is rounded up to the nearest RM250 block.

  • Security deposits and utility deposits are generally not subject to stamp duty.

  • The calculation applies per year of tenancy.

  • For multi-year tenancies, stamp duty is calculated based on total rental for the entire term
